1. PREAMBLE
These general terms and conditions of use and sale (the "GTCUS") constitute the basis of the contractual relationship between the customer and MSC FILLE AU PLURIEL, a simplified joint stock company registered with the Montpellier Trade and Companies Register under number 538 617 200, with its registered office located at 491 rue du phare de Roquerols – 34000 Sète. The GTCUS are present on the website edited by Fille au Pluriel, namely: www.filleaupluriel.fr (the "Site"). They are systematically sent or given to each customer (hereinafter the "Customer") to allow them to place an order for products sold by Fille au Pluriel.
By checking the box provided for this purpose, the Customer acknowledges having read the GTCUS and accepting them before placing an order. The GTCUS may be supplemented by special conditions of sale or purchase orders. By accepting the GTCUS, the Customer expressly waives the right to invoke their own general terms and conditions of purchase.
The fact that Fille au Pluriel does not invoke any of the GTCUS at a given time cannot be interpreted as a waiver of the right to invoke any of these conditions later. Fille au Pluriel reserves the right to modify its GTCUS. They will then be applicable as soon as they are posted on the Site.
2. PRODUCTS AND PRICES
The products sold on the Site (the "Products") are described with the greatest possible accuracy. Fille au Pluriel strives to provide a photographic illustration for each Product. However, a slight difference between the illustration and the actual Product cannot engage Fille au Pluriel's responsibility.
Product Description
Each product is accompanied by a detailed description including its essential characteristics and usage advice. In case of product modification by the manufacturer, Fille au Pluriel will update the Product description as soon as possible.
Product Prices
The prices indicated on the Site are in euros excluding tax (HT) and do not include delivery charges, which are indicated before order validation. The total amount due by the Customer is specified on the order confirmation page. The applicable price is the one in effect on the day of the order.
Delivery charges are billed in addition. In case of a price change, the new rate will not apply to orders already confirmed.
3. ORDER AND PAYMENT
Identification and Account Creation
To place an order, the Customer must identify themselves on the Site by entering their email address and password. For the first order, the Customer will need to create an account by providing the necessary information (name, first name, email address, phone number, postal address, SIRET).
Order Process
After selecting the desired Products, the Customer chooses their delivery method from the options offered (DPD, Colissimo, DACHSER, pickup in Sète). Before clicking on "Confirm order", the Customer has the opportunity to check the details of their order and correct any errors.
Once the order is validated, the Customer receives a confirmation email. Fille au Pluriel reserves the right to block an order in case of a problem (payment default, invalid email address, etc.).
Order Payment
Payment for Products is made by credit card (Carte Bleue, Visa, Mastercard), check, ApplePay, Payconic or bank transfer initiation. The order price will be debited upon payment validation. The order will be processed upon receipt of bank funds. In case of payment by transfer, a delay may be expected. In case of payment default, Fille au Pluriel may terminate the sale as of right and demand the return of the Products.
4. DELIVERY
Delivery is understood as the transfer to the customer of physical possession or control of the products, either to the address indicated during the order, or by pickup at Fille au Pluriel's premises.
Delivery Methods and Costs
Deliveries to metropolitan France and Corsica are free for orders over €250 excluding tax. For other territories, including overseas, delivery charges are billed in addition.
Delivery times are indicative. Delays cannot give rise to damages, retention or cancellation of the order, except in cases of force majeure. In case of significant and unjustified delay, the Customer may request a refund in accordance with Article L. 216-2 of the Consumer Code.
Order Tracking
A tracking number is provided to the Customer to follow the progress of the order.
5. PRODUCT RETURN AND RIGHT OF WITHDRAWAL
Right of Withdrawal
The Customer has a period of fourteen (14) calendar days from the receipt of the product to exercise their right of withdrawal. Returned Products must be intact, unused and in their original packaging. Return shipping costs are the responsibility of the customer except in cases of delivery error or non-conforming product.
Recourse to Customer Service
In case of a defect or problem with a product not related to transport, return shipping costs may be reimbursed by Fille au Pluriel upon presentation of the package shipping invoice.
Exclusions
In accordance with Article L. 221-28 of the Consumer Code, certain Products cannot be returned (e.g., opened and unsealed Products).
Refund Procedures
Fille au Pluriel commits to refund the Customer either in the form of credit added to their customer account, or by bank transfer, as soon as possible after receipt and verification of the returned product.
Non-Conforming Products
In case of receipt of a defective or non-compliant Product, the customer must express their reservations within three (3) days following receipt. An exchange or refund will be offered subject to verification of the returned product.
6. PERSONAL DATA
Fille au Pluriel commits to protecting the Customer's personal data in accordance with the GDPR. The collected data is necessary for order processing. It is neither sold nor communicated to third parties.
Data is kept for a period of five (5) years from the Customer's last order. The Customer has the right to access, modify, delete and port their data. To exercise these rights, the Customer can contact Fille au Pluriel at the following address: contact@filleaupluriel.fr.
7. LIABILITY
Fille au Pluriel cannot be held responsible in case of non-execution or poor execution of the contract due to the Client, a third party, or a case of force majeure.
8. MEDIATION AND DISPUTE RESOLUTION
In accordance with Article L. 612-1 of the Consumer Code, the Customer may use a consumer mediator to amicably settle any dispute with Fille au Pluriel. E-commerce mediator of FEVAD (Federation of e-commerce and distance selling) http://www.mediateurfevad.fr
9. APPLICABLE LAW AND JURISDICTION
These GTCUS are governed by French law. Any dispute will be subject to the exclusive jurisdiction of the Court of Appeal of Montpellier, after an attempt at amicable resolution.
10. INTELLECTUAL PROPERTY
All elements of the Site (texts, images, logos) are the exclusive property of Fille au Pluriel. Any reproduction without prior authorization is prohibited. Third-party content present on the Site remains the property of their respective authors.
11. FORCE MAJEURE
Fille au Pluriel cannot be held responsible for any delay or non-performance of its obligations in case of force majeure as defined by French jurisprudence.
